The Citizens Fiscal Advisory Committee has scheduled a meeting for Monday, December 12, 2011 at 7:00 PM.

Man on a Moose....You are absolutely on the right track. The way the law is constructed, the salaries of elected officials published with the Preliminary budget are to survive intact to the Final Budget. They cannot be changed from the Preliminary published amounts without the procedures separately outlined in the law. By changing the amounts for the Receiver of Taxes and the Supervisor on the salary schedule which some have and some don't, the majority acted outside the provisions of the law.

Have to give her credit for seeing DeF for what he is.
Not so much Danaher - but Cristo played ALOT of games back in 2009 and when he was confronted on them, he gets angry - quickly. If the malcontents, specifically Ann Taylor, Dwight Jenkins and Ed Knowitall Gilbert had taken the time to investigate, they would have found out that Rich Benko was initially slated to be the Asst. DPW Commissioner. However, when Jim Moore took another position outside the town of EG - Rich Benko assumed all responsibilites on the Planning Board and had not been working as the Asst. DPW Commissioner. Mr. VanWormer had in fact, assumed all duties connected with both positions. Second, and more importantly, the Knowitalls should have realized that this salary is for next year that there is no Asst. DPW Commissioner slated in the budget. Mr. VanWormer will be doing all of those responsibilities single handledly.

ReplyDeleteI seem to recall Supervisor McCabe saying at the 2011 Org. Mtg. that Mr. Benko would function as Town Engineer but couldn't be appointed to that title until his engineering license is reinstated.

Furthermore, the salary scheduled attached to the Preliminary 2012 Budget has no "Deputy Commissioner of Public Works" but does have a "Town Engineer".

Dear Sleepy.....I have the Salary Schedule which was prepared (and released to some) which to this point is to go with the Final Budget. It is a real piece of paper, and it is also the one Ed has. It has the $60K Supe salary and the increased Toni salary. The majority found out that they didn't follow the law and had to back off. Ed did his homework and is correct in his statements on the TU blog.

Living... We are talking about the SALARY SCHEDULE which is to be published with the Preliminary and the Final budgets. It contains the SALARIES to be actually paid. You are confusing yourself with the Budget P/S lumps which can be allocated between different funds.
ReplyDeleteIt is the SCHEDULE which drives what is actually paid to individuals and the law treats elected officials differently than appointed employees listed on that SCHEDULE.
With regard to Elected officials, the law states how the salaries are to be treated in the budget process. The budget process is set up in the law so as to prevent the scenario which the Board tried to accomplish. Can you imagine the chaos which would take place in every Town in NYS which experienced the same kind of election result as we had in EG if the majority of either party could jerk around a newly elected official of the opposite party? That's why salaries of elected officials are "protected" during the election process. They can be changed later - subject to the provisions of the law. In EG, the elected officials are the Town Board (including the Supervisor, the Receiver of Taxes and the Town Clerk. (Some Towns have an appointed Receiver of Taxes and an elected Commissioner of Public Works. The distinction is Elected or Appointed.)
The Board still has a problem because they did produce a salary schedule with the Final budget which has the Supervisor's salary listed at $60K. I have a copy, and I should have duplicated it for last night's Board meeting. Look at the tape and you will see Board members stating that Keith's salary is $70K... But on what schedule?
uh where was ed wrong? he confirmed that Tony is getting a 5000 dollar raise he confirmed that the DPW chief is getting a 12000 dollar raise.It was interesting that the board would not commit to a salary for the supervisors secretary guess that one is still being negotiated. (a full month AFTER the budget is "final".) I suspect that they backed off the reduction of the supervisors salary when Ed shined a light on what they were up to. in today's advertiser Rick Matters states that there was no Salary Schedule attached to the Budget he received either.

As far as an 18% raise - is the town better off giving someone a nice raise for taking on an additional job and saving the residents of EG a substantial amount of money - or would you prefer we pay someone else to do the Deputy Commissioner of Public Works job at a substantially higher cost to us all?

I was at the Town Board meeting Wednesday night and couldn't help but notice how Ed Gilbert continually stared at Phil Malone. Does Ed have a crush on Phil or is he so envious of Phil and Phil's position on the Town Board, a position, I might add, that Ed coveted badly, that he is losing control of his senses? Poor Ed - I hope you can put your jealousy aside and get over it.

would not make it true. I am surprised that your original comment was even allowed in the discussion as it really has no redeeming value. What I have noticed about Ed is that he will call out anyone when he thinks they deserve it. I remember him giving Rick Matters a hard time when he delayed the vote on the Fed Ex PDD.

@7:22 Man I still don't get why people aren't grasping this. I’ll try once again. Yes I get that the public is not going to get into the minutia of every Board decision there is plenty of every day business that the Board and the supervisor deal with that would get bogged down if the public was to weigh in on every decision. That is why we have a Democratic Republic. We democratically chose our representatives to handle the public's affairs
and represent us.
At the local level there are laws that require public notice and discussion about important matters. One of those is the Annual Budget. The
law requires a public hearing on the budget and a certain amount of disclosure. The idea is to let the public know what is planned for the
coming year and get public input on how the town is spending our tax dollars. When that hearing is held the public assumes they are being dealt with frankly and honestly by those that are presenting the annual budget. Certainly some tweaking is expected before the final budget is passed. Budgets by their nature are fluid documents up until they are finalized.
Here is the issue at hand, the budget presented to us at the Town hall meeting wasn't tweaked it was overhauled. It had huge differences in lines for offices and salaries. The CFAC recommended a two percent raise for non
unionized town hall employees, it was not in the budget. Six Days later it is a 3 percent raise (or more). There were major swings in salaries as well. The required disclosures that have been part of every recent budget are still missing. It is evident that the public was not given a frank and honest assessment of the annual budget at the public hearing. People don't like being intentionally misled. I feel and I don't think I’m alone, that when your government acts in this way the citizens have an obligation to call them on it. You may consider it jealousy, or being a malcontent, I
consider it a duty.

ReplyDeleteNow I think the Board has a serious problem in that they passed a Final budget with a salary schedule that did not preserve the elected officials salaries at the amounts disclosed with the Preliminary budget. I don't know how they are going to fix it. They may try to muddle it thru and hope nobody raises a fuss. But I think they'll still have an "illegal" budget which I would guess might be open to challenge at some point in the future.

Mr Johnson check with the Association of Towns they will tell you whether it is or is not legal to give the Receiver of Taxes a raise after the preliminary budget. I'm sure if it's illegal she would have to refuse it.
ReplyDeleteI think the question could be asked of the Association of Towns, but probably more appropriately asked of the Office of the State Comptroller. I think the crucial distinction is whether an official is elected or not. I think the question to be put to OSC is whether elected official's salaries stated in the Preliminary budget salary schedule are preserved to the Final budget salary schedule, and then open to change in the manner prescribed by the law.

She asks why the Commish. should get a raise for doing both jobs when the D/C job has bben done for free in previous years. This just shows how uniformed she really is, since in 2010, there were 2 paid Deputies at 10K each!! 1 of them being the Commissioners brother in law, Red Guynup!!! For the budget in 2010, we had 2 people covering the responsibilities of the Deputy Commissioner of Public Works. In 2011 it was 1 person. Then in 2012 the position is no longer needed. What I would like to know is; why did we need the position in the first place?

They never ever learn, those rebooblicans. All Corine had to do was shut the eff up and not cause trouble and she would have a nice cushy town hall job. But that's not happening now. The rumor mill has it that Keith was going to make her the bookkeeper until she started trouble, like that farticle in the Troy Record. Will they EVER learn that when they cause trouble it always backfires? I sure hope not!

ReplyDeleteWe have bigger problems; what are they? Supervisor McCabe is finally going to get the freedom he so deserves - he's been an inspiration to many of us. Supervisor Elect Langley will now get the opportunity to run the town as efficiently as he sees fit with the help of Malone, Mangold, Matters and O'Brien; yes a team of Democrats working with Supervisor Langley; yes thats right -- Who will turn against him in a short period of time and make his four years miserable? That answer is simple; the Ann Taylor's, Mike Cristo's and Chris DeFruscio's. Why is that? because he will do the right thing and OMIT these "troublemakers" from his list of people he knows. You see fellow problem-makers it will be a win-win situation for the new Supervisor Elect; unfortunately for Mr. McCabe he had to take the brunt of all that went wrong in this town and he did it with dignity and class. He was blamed for Rt. 4 Corridor, Fed Ex, for floods in the town, for mailboxes being torn down and for so many other issues that came up; it was all his fault. Yeah right?

Hey Timmy....It is highly irregular and unacceptable professional practice for an auditing agency to give an auditee three months between an engagement letter and actually beginning an engagement. You might want to ponder and/or investigate the implications.

The State - ( OSC ) is in the house and I trust that they will perform an admirable and complete investigation , and when it comes out that there was no wrong doing and NOTHING illegal was performed - I will encourage all the board members and the soon to be ex-Supe , to file the appropriate lawsuit to stop the never ending nonsense from people who simply don't get it!

ReplyDeletePat must be sick of all of the crap perpetrated by his son. I'm sure Pat loves his son but has lost a lot of friends and endured a lot of embarrassment because of Mike's behavior. Knowing Pat, he would want to mend fences and try to get along for the benefit of the town. That doesn't sound like one of Mike or Ann's goals...getting along is just not something they would understand.
Just my feeling on who Old EG really is.
What does it matter what Keith Langley is? He's going to do his best for the community and thats the way it is. He's far from a stupid man, and he knows who the "devils" of this town are or should I say trouble makers are and he'll stay clear of them. Its not rocket science; you know who's going to bring you down and who's going to truly be there for you. His presence in the Town Hall has been made, and he seems like a man of class and honor. So you mean and nasty Republicans or whatever you call yourselves - go suck on an egg; move out of state - or do whatever it takes to "go away" for the upcoming year and let him do what it takes to run this town.
