JUST A COMMON SOLDIER (A Soldier Died Today)

He was getting old and paunchy and his hair was falling fast,
And he sat around the Legion, telling stories of the past.
Of a war that he had fought in and the deeds that he had done,
In his exploits with his buddies; they were heroes, every one.

And tho' sometimes, to his neighbors, his tales became a joke,
All his Legion buddies listened, for they knew whereof he spoke.
But we'll hear his tales no longer for old Bill has passed away,
And the world's a little poorer, for a soldier died today.

He will not be mourned by many, just his children and his wife,
For he lived an ordinary and quite uneventful life.
Held a job and raised a family, quietly going his own way,
And the world won't note his passing, though a soldier died today.

When politicians leave this earth, their bodies lie in state,
While thousands note their passing and proclaim that they were great.
Papers tell their whole life stories, from the time that they were young,
But the passing of a soldier goes unnoticed and unsung.

Is the greatest contribution to the welfare of our land
A guy who breaks his promises and cons his fellow man?
Or the ordinary fellow who, in times of war and strife,
Goes off to serve his Country and offers up his life?

A politician's stipend and the style in which he lives
Are sometimes disproportionate to the service that he gives.
While the ordinary soldier, who offered up his all,
Is paid off with a medal and perhaps, a pension small.

It's so easy to forget them for it was so long ago,
That the old Bills of our Country went to battle, but we know
It was not the politicians, with their compromise and ploys,
Who won for us the freedom that our Country now enjoys.

Should you find yourself in danger, with your enemies at hand,
Would you want a politician with his ever-shifting stand?
Or would you prefer a soldier, who has sworn to defend
His home, his kin and Country and would fight until the end?

He was just a common soldier and his ranks are growing thin,
But his presence should remind us we may need his like again.
For when countries are in conflict, then we find the soldier's part
Is to clean up all the troubles that the politicians start.

If we cannot do him honor while he's here to hear the praise,
Then at least let's give him homage at the ending of his days.
Perhaps just a simple headline in a paper that would say,
"Our Country is in mourning, for a soldier died today."

Subject: 2016 Tentative Budget Questions

On October 1, I sent the following to George Phillips, Town Comptroller, with a copy to Supervisor Langley and Councilpersons DiMartino, Malone and Matters and Director of Finance/Deputy Supervisor Hart.  No response has been received.

On that same day, I submitted a FOIL Request for an excel copy of the 2016 Tentative Budget. No response has been received.

I realize the 2016 Tentative Budget won't become public until this afternoon, however, I'm hoping to beat the rush by submitting this in advance. 
 
Please provide me with an excel copy of the 2016 Tentative Budget as quickly as possible after the budget is made public (I'd like to go over it this weekend).
 
I'd also like the following questions answered as quickly as possible after the budget is made public.
 
Are there property tax increases?
Is the Tax Levy Cap exceeded? 
Are there fee increases, especially Sewer & Water? 
What date is used for the YTD column? 
What are Sales and Mortgage Tax estimates based on?   
How is the 2016 WWTP debt service funded?  
 
Staffing levels 
Maintain current? 
Current vacancies to be filled?
New positions to be created and filled? 
Existing positions to be abolished?   

Equipment (including vehicles) 
Replacement equipment purchases? 
New equipment purchases?  
Are any Fund Balances used to support projected expenditures?  
Is Contingency Account funded?

Voter Disconnect?


This year marks the 50th anniversary of the March on Selma - an historic event for America, its values, freedoms and rights!

Activists marched to protest Selma’s intransigence to black voting.  Reportedly, ridiculous questions were asked of blacks attempting to register to vote. … how many bubbles on this bar of soap? … how many jelly beans in this jar?   

Fast forward to the present and we see voters standing in day-long lines in many parts of the country, state legislatures enacting laws to disenfranchise certain segments of the population, the Supreme Court striking down portions of the 1965 Voting Rights Act.  Are we going backwards? 

Voter turnout peaks in a Presidential Election year, drops in Gubernatorial Election years and plummets in the “off years” … the local elections.

Yet the local elections are where your vote can have the most impact, directly determining the outcome!   

Why the disconnect?  Why is voter turnout so low for local elections? 

Your vote in local elections counts far more than in a Presidential or Gubernatorial election:

As a Registered Voter YOU are:
1 of 146,000,000 in America.
1 of 11,700,000 in New York.
1 of 11,000 in East Greenbush!

Local elected officials are the most accessible – they are our friends and neighbors, possibly even our relatives.  City and Town Halls are nearby and open.  Meetings are open to the public and the public is often allowed to speak.  Try doing that in the State’s or Nation’s Capital!

Local elected officials’ decisions affect us on a daily basis, deciding issues like taxes, education, policing, snow removal, potable water, sewage treatment, residential/commercial development, parks and other amenities … decisions that make a community a desirable or undesirable place to live. 

The Selma marchers and voters waiting in day-long voter lines should inspire us to vote.  It takes all of 10-15 minutes to vote here in East Greenbush … why then do so many opt out?

Your East Greenbush vote counts!  Be sure to vote this November 3rd!

The candidates for East Greenbush Town Supervisor and Town Council in East Greenbush will debate in two sessions on October 15th in the Columbia High School auditorium. 

The public is encouraged to attend and will be invited to submit potential questions for each session.

Town Council candidates will debate from 6:30 – 7:30 p.m.

Supervisor candidates will debate from 7:30 – 8:30 p.m.

All Supervisor and Town Council candidates have been invited to participate.

The Town Board of the Town of East Greenbush has scheduled a special meeting to present the Town Board with the 2016 Tentative Budget.  The meeting is scheduled for Thursday, October 1st at 4:00pm at the East Greenbush Town Hall.

**Please be advised that this meeting- the Presentation of the Tentative Budget is being held in accordance of NYS's Town Law Section 106 (3).  The Town Clerk formally hands each Town Board member a copy of the 2016 Tentative Budget and they sign an acknowledgement that it was received before October 5th.  There is no presentation of the actual budget.  The 2016 Tentative Budget will be posted to the Town's website for the public to view by noon, October 2nd.  The presentation takes place during a Public Hearing in accordance of NYS Town Law Section 108, this meeting is scheduled for November 5th and the time will be determined at the regular October Town Board Meeting on Wednesday, October 21st at 7pm **

Dave, Toni, Andrea and I will appear on the Working Families Ballot so fill in the little circle above our names. Bridget Fritz is a "Write In" on this ballot sheet. So you need to write her name in the appropriate box.

Happy Labor Day

Today is Labor Day, the "unofficial end of Summer". Hopefully we'll have plenty of good weather left, a beautiful Autumn and a mild Winter.
 
The US Department of Labor, states that Labor Day "is a creation of the labor movement and is dedicated to the social and economic achievements of American workers. It constitutes a yearly national tribute to the contributions workers have made to the strength, prosperity, and well-being of our country." http://www.dol.gov/opa/aboutdol/laborday.htm
 
We can still revel in "the social and economic achievements of American workers (and) the contributions workers have made to the strength, prosperity, and well-being of our country" and I suggest that we wholehearted do so.
 
We marvel at the accomplishments of labor… the soaring skyscrapers, expansive highways, fabulous cars and trucks, beautiful homes, etc., and appreciate those who built them. And we should remember and celebrate labor's and our own accomplishments.

Campaigning at Town-sponsored Events

Jessica Lansing did a fabulous job of organizing the event and should be congratulated, as should all of the Town's employees who were involved in making the event a success.

Yesterday at the Town Festival, Supervisor Candidate Mike Poorman set up what could be best described as a campaign headquarters.  Many, including myself as Chair of the EGDC, were upset by this.

I first heard about Mr. Poorman's booth when I asked Jessica if it would be alright for us to provide Voter Registration Forms and Absentee Ballot Applications to those in need of same.  She appeared to be rather upset about Mr. Poorman's exhibit when she mentioned it. 

I attempted to locate DPW Commissioner Corellis, who has jurisdiction over the physical parks, and who I had seen moments before seeing Mr. Poorman's booth from a short distance, but was unable to find him.

I called Deputy DPW Commissioner Fiacco who, although not at the Town Festival, had admitted seeing Mr. Poorman's booth and being upset.

As you may know, Town-sponsored events, such as yesterday's Town Festival, Music in the Park and the former Saturday in the Park, have long been considered by convention and practice, rather than by explicit Town Policy, to be campaign free or neutral territory.

I've taken the liberty of drafting the attached resolution for your consideration, however, I'll naturally defer to your judgment and that of Town Attorney Gruenberg as to whether or not to introduce same. 

I also am wondering whether this would be more appropriately addressed in the form of a local law.

I sincerely hope you act in one manner or another to formalize this convention and practice.

XXX-2015 Resolution Prohibiting Active Political Campaigning, Display of Campaign Signs and the Distribution and/or Availability of Political Campaign Literature on Town of East Greenbush Property During Town-Sponsored Events

 WHEREAS, the Town of East Greenbush sponsors numerous events for the public’s entertainment and enjoyment, including but not limiting Music in the Park and the Town Festival, formerly called Saturday in the Park; and 

WHEREAS, such events are conducted for the public benefit using Town resources, including staff and their time in the Town’s employ; and  

WHEREAS, such events have long been considered by convention and practice, rather than by explicit Town Policy, to be campaign free or neutral territory insofar as active political campaigning, the display of campaign signs and the distribution and/or availability of campaign literature, now therefore be it  

RESOLVED, it is hereby determined to be Town Policy that active political campaigning, including the display of campaign signs and distribution and or availability of political campaign literature at Town-sponsored events is hereby prohibited; and be it further

RESOLVED, that the provisions of this Resolution shall not prohibit the display of a singular banner displaying a political party’s or political organization’s name or the provision of oral information when asked by a member of the public attending such events; and be it further 

RESOLVED, that the provisions of this Resolution shall not apply to events sponsored by a political party or candidate provided that the political party or candidate has properly rented Town property for such event.

East Greenbush Citizens Fiscal Advisory Committee (CFAC)

What’s happening with CFAC?  The last scheduled meeting was April 8, 2015 and the last posted Meeting Minutes are for January 29, 2015. 

The April 8, 2015 Agenda states:
·         Acknowledgement of no meeting in February due to winter storm and lack of quorum
·         Acknowledgement of no meeting in March due to illness and lack of quorum

“185-2010 Resolution to Abolish the Town Finance Committee and to Create a Citizens Fiscal Advisory Committee” adopted unanimously on December 8, 2010 states: “the Committee shall meet at least once a month”.

At the December 17, 2014 Town Board Meeting, Resolution “147-2014 Request by Town Board for the Citizens’ Fiscal Advisory Committee to Draft Internal Controls Relative to the Operation of Town Government” was determined to not be needed and CFAC was supposedly assigned this task. 
 
I raised this issue at the August 19, 2015 East Greenbush Town Board Meeting which yielded no response.

One can only wonder how they’re doing.

A REMINDER TO PARTIES, CANDIDATES AND THEIR SUPPORTERS

East Greenbush Comprehensive Zoning Law
 
3.3.4 Exempt Signs - The following signs may be erected and maintained without a permit or fee, providing such signs comply with the general requirements of this Section and 3.3.5 Temporary Signs.
 
P. All other temporary signs, such as political posters, banners, promotional devices and other signs of a similar nature, including church, school, civic or other non-profit functions, shall be permitted for a period of not longer than six (6) weeks prior to the event nor longer than seven (7) days after the event, except as otherwise provided by this section. No permit is required for these signs. Such signs shall not exceed thirty-two (32) square feet, nor be placed in a position that will obstruct or impair traffic or in any manner create a hazard or disturbance to the health, safety, and welfare of the general public.
 
3.3.5 Temporary Signs
 
A. No person shall place or erect any temporary sign on any public property owned by the Federal Government, State of New York, the Town of East Greenbush, New York, or any other municipality, special town water or sewer district or school district, including the paved and unpaved rights-of-way of roadways, located in the Town of East Greenbush, New York.
 
B. No person shall place or erect any temporary signs on any private property located within the Town of East Greenbush without the express permission of the owner of the property.
 
C. No signs shall be placed on the sides of overpass or underpass vehicular bridges, on poles carrying utility lines, traffic signals, street lights or telephone lines, and on direction or traffic signs.
 
D. No sign shall be erected or placed as to obstruct or impair vision at any road intersection, or the entrance to and exit from private driveways.
 
E. It shall be the responsibility of the person erecting or placing any temporary sign to cause its removal.

Letter to NYS Comptroller DiNapoli

I recently wrote to NYS Comptroller DiNapoli requesting that his office expand the scope of the current East Greenbush audit to include an investigation into the use of the GEIS Mitigation Fees (copy below).

However, I am not sure that one voice is sufficient to convince Comptroller DiNapoli to do so.

If you share my concern about this potential misuse of GEIS Mitigation Fee proceeds, please write to Comptroller DiNapoli and copy Chief Examiner Jeffrey P. Leonard at the following addresses supporting my request.  Include a copy of my letter as a reference.

A simple note might be sufficient:

I am writing in support of Peter Stenson's attached request that you expand the current East Greenbush audit to include an investigation into the use of the GEIS Mitigation Fees.

6/17/15 EAST GREENBUSH TOWN BOARD MEETING

A consultant at the 6/11/15 Pre-Board Meeting pitched a multi-municipality NYS State Department Local Government Efficiency Grant application to establish a Municipal Infrastructure Rapid Response Team, whereby a member experiencing a sewer, water, snow or flooding emergency would be assisted by other members’ available equipment and crews, with expenses paid by the member needing assistance.

There are modest application development and submission costs and, if the grant is awarded, local matching funds requirements (possibly including in-kind staff services).  The grant would pay for planning and implementation costs, including unique equipment for use by the members.    I personally support shared services agreements, especially if grant money is available.

108-2015 was nonetheless defeated at the 6/17/15 Board Meeting, with Supervisor Langley and Councilperson Malone voting “Yes” and Councilpersons DiMartino and Matters objecting.  Perhaps over concern that EG would be a net assistance giver, but costs are reimbursed!

The same votes defeated 109-2015 to hire Chazen Companies to write other Grant Applications. EG’s Planning Director and/or Engineer could do this if not fired by the Majority.

Note: NYS’s Consolidated Funding Applications are due 7/31/15.  Hence the rush.

98-2015 Filling Ethics Board Vacancy failed with CPs DiMartino and Matters voting “Yes” and Supervisor Langley and CP Malone voting “No”.

Noteworthy resolutions receiving unanimous approval:

100-2015 Appointing Police Officer - Congratulations & welcome to John DeRubertis;
103-2015 Certain Paving Expenses;
104-2015 Designating a Portion of Lakeshore Drive One-Way from 6/19/15 to 9/18/15;
106-2015 Emergency Repair of Old Troy Road Bridge; and
107-2015 Chazen Companies Bridge Condition Assessment of Old Troy Road/Mill Creek Bridge.

Thankfully, the many attachments referenced in the Resolutions were included in the on-line Agenda. 

Aside: Resident (A) complained that two residents, including yours truly, had spoken during the Open Public Privilege portion.  Resident (D) suggested banning (A) from speaking at future meetings or at least gaveled out of order.  I disagree with banning people but support gaveling them.  

Remember, “Better to remain silent and thought a fool than speak and remove all doubt!

Also, we don’t need various audience members shouting “Order!”

6/4/15 Special East Greenbush Town Board Meeting

The EG Town Board held a Special Board Meeting on 6/4/15 to consider nine resolutions authorizing about $600,000 in change orders to essentially return the Waste Water Treatment Plant to its 3/11/15 pre-spill condition and push the renovation project’s completion date back 151 days to 11/25/15.

The resolutions were initially introduced at the 5/20/15 Board Meeting; however, Councilpersons Deb DiMartino and Mary Ann Matters would not act due to the lack of documentation and justification supporting  the resos and the change orders.

CPs DiMartino and Matters held a public meeting with Delaware Engineering and The Chazen Companies, the WWTP renovation design and construction management consultants, to discuss their concerns and questions on 5/27/15.  The few issues remaining after that meeting were apparently resolved and the resos were unanimously adopted today (6/4/15).

At the beginning of the Special Meeting, CPs DiMartino and Matters reiterated their complaints about the lack of information coming from Supervisor Langley. 

Why does he refuse to share, especially when calling the WWTP situation “an emergency” and unsuccessfully imploring Delaware and Chazen to do the same on 5/20/15?  He doesn’t play well with others, I guess.

Supervisor Langley’s most recent cover-seeking “Supervisor's Report” states “I agree that everyone who is in the position to make decisions should have the ability to ask questions”.  They evidently ask the questions – you just don’t give them the documentation and justification needed to do their jobs!

One of CPs DiMartino and Matters concerns was possible financial exposure if the insurer doesn’t reimburse the spill-related costs of Delaware and Chazen - costs which wouldn’t be known until after the work was done.

I suggested that the Sewer Funds generally have sizable positive fund balances which might be used for these ‘soft’ costs if not reimbursed.  There it is, in both the Delaware and Chazen resolutions: “covered by Sewer fund balance for the portion of the current proposal estimate limit denied by insurance”.
 
It’s not rocket science, Supervisor Langley, just communication, cooperation, working together and, most importantly, adult behavior!
