Jack Conway does write clearly about the issues facing the ZBA and the Planning Board. And the Gaming Commission has already addressed and answered the question the ZBA is supposed to be "interpreting."
In the Question and Answer sessions held for the developers, the very issue which is before the Zoning Board of Appeals was addressed. The answer of the Gaming Commission is very clear, and should put to rest the dubious argument which Capital View is trying to make. Capital View is trying to say that because the Request for Applications stated that "amenities" had to accompany the gaming activity, the "amenities" also benefited from the exemption from local zoning law that gaming enjoys. Here's the question asked and the answer provided by the Gaming Commission. The Zoning Board should pay attention to this one:
"Q.327. Do the preemption provisions of N.Y. Racing Pari-Mutuel Wagering and Breeding Law Article 13 extend beyond the "gaming floor"? Because the statute requires at least one hotel and other facilities, it is not clear why preemption doesn't extend beyond gaming activities.
A.327. See N.Y. Racing Pari-Mutuel Wagering and Breeding Law § 1366 and the answer to Question 184.
The preemption of local zoning and land use under N.Y. Frankly, I think there was a lot of miscalculation. I think they thought they could easily politically "fix" any problems with zoning and environmental issues when they were selecting property. (Look how easy that Plat approval was on the property that's caused the two recusals from the Board and Planning. It was done without a meeting or an authorizing resolution last January.) Remember the comment in the FOIL'd notes about getting to Jim C. and Matt P. about getting the ducks lined up? And then they come in with a lot of double talk about amenities being exempt from local zoning, when the Gaming Commission has specifically spoken on the issue - quoted above.
According to NYS Zoning Laws, if there is a protest to an amendment or variance the town board must vote and they need to win by a supermajority vote. Wouldn't Mary Ann's no and Sue's recusal make this impossible?
Anony 9/26 p.m.Possibly but not definitely. There's more to it than just a protest. Dig deeper. This would explain, however, why Sue Mangold said "I'm just afraid my recusal will blow this deal." Miss "I Didn't Know My Brother Has Investments In The Project" knew well before April that IF EG gets a license, and that's a big IF, they could very well be in jeopardy of losing the rezoning fight. That's why she voted and didn't recuse herself until she got a letter from a lawyer demanding her recusal. She then gave up without a fight. Needless to say, time will tell all.

I attended the pre-board meeting on Thursday and Pete Stenson was a real asset in what turned out to be the first productive public conversation about the town's finances in memory. He was put on the spot without warning and, as always, spoke in a straightforward way about steps he had taken and where he left things when the new majority took over in January. I know Pete doesn't need defending from me, especially from the clowns on the non-blog, but this would be a much better town if everyone conducted themselves in public like Pete Stenson. No matter how heated things get, he's always a gentleman. If you ask him a question, you get an answer, and if he asks you a question he actually listens to your answer. I enjoy arguing with Pete as much as agreeing with him because it never gets personal and I learn a lot from his insight and experience. I realize that I can rub people the wrong way because of the way I go about things but launching personal attacks against Pete tells me more about you than him.
With Langley it's all about loyalty. And loyalty to Langley means associating only with people on his "APPROVED" list. He's happy to keep you in isolation if it means you won't talk to people he doesn't like. He's a real control freak.
Petes detractors are those who are so jealous of his ability to speak intelligently and calmly without malice. Defruscio,Gilbert and Tirino would do well to sit back and take a lesson in public speaking from Pete ! They would also do well to sit back and edit their inability to read and write.

Dear Corruption in EGOctober 12, 2014 3:56 PM---You're absolutely right. Republicans did complain when McCabe & Co. practiced nepotism and it was not only his daughter. His nephew was hired in the PD and other family members were hired. You are also right that the current "regime" is practicing nepotism and does seem to be doing it on a much larger scale. But that does not make what the previous administration did, right. It only makes the current administration WORSE but it doesn't make the previous administration right. Unfortunately Supervisor Keith & Co., has made so many things worse and his secrecy and dictatorship style of governing brings even more suspicion regarding his reasons and actions. We agree--Supervisor Keith & Co. is lousy. He is missing so many skills necessary for the office of Supervisor and he needs to go next year. But we need the right person to replace him. it would be nice if we were not having to chose between the lesser of 2 evils this time. It would be nice if we had a genuinely good person challenging Keith next year.

It's really a shame. Langley and his team had so much support in January and potential to be great but the casino brought them down. Keith, you knew during campaign season 2013 about plans to bring a casino here but did you share that information with your candidates? Was the plan all along to drop the bomb on them post-election? Did you ever tell the candidates your expectations of them prior to them signing on? They had no idea what or who they were getting mixed up with, did they? Langley finally broke down and made an appt to the CFAC. And the winner is...Sean Mulvey! Langley's circle of friends is now so small that he couldn't come up with anyone else but Sean Mulvey, who doubles as the obnoxious loud mouth in the room no matter where he is. Megaphone Mulvey also serves as Treasurer on the Repub Committee. This is a disappointing pick for the CFAC. Clearly, to show his contempt for this committee, Langley deliberately picked someone who will be more of an impediment than an asset. Chalk up yet another error in judgment for Supervisor Langley.
How can you possibly appt. Sean Mulvey to the CFAC when you fired his arse from the Town? Where's Langley's priorities or doesn't he have any? One minute they're enemies, next their the best of buds. Supe, where's your sense of pride? Its like you don't have a clue; well its time you at least try - 15 months is going to fly by and you'll be saying Bye Bye!! As far as your forever bud, DENFRUSCIO, send him to a GED class, would you? His grammar when he writes is very strange; can't put sentences together and his spelling is atrocious. The answer of the Gaming Commission is very clear, and should put to rest the dubious argument which Capital View is trying to make. Capital View is trying to say that because the Request for Applications stated that "amenities" had to accompany the gaming activity, the "amenities" also benefited from the exemption from local zoning law that gaming enjoys. Here's the question asked and the answer provided by the Gaming Commission. The Zoning Board should pay attention to this one:
"Q.327. Do the preemption provisions of N.Y. Racing Pari-Mutuel Wagering and Breeding Law Article 13 extend beyond the "gaming floor"? Because the statute requires at least one hotel and other facilities, it is not clear why preemption doesn't extend beyond gaming activities.

I think they thought they could easily politically "fix" any problems with zoning and environmental issues when they were selecting property. (Look how easy that Plat approval was on the property that's caused the two recusals from the Board and Planning. It was done without a meeting or an authorizing resolution last January.) Remember the comment in the FOIL'd notes about getting to Jim C. and Matt P. about getting the ducks lined up? And then they come in with a lot of double talk about amenities being exempt from local zoning, when the Gaming Commission has specifically spoken on the issue - quoted above.
DeleteAccording to NYS Zoning Laws, if there is a protest to an amendment or variance the town board must vote and they need to win by a supermajority vote. Wouldn't Mary Ann's no and Sue's recusal make this impossible?

This would explain, however, why Sue Mangold said "I'm just afraid my recusal will blow this deal." Miss "I Didn't Know My Brother Has Investments In The Project" knew well before April that IF EG gets a license, and that's a big IF, they could very well be in jeopardy of losing the rezoning fight. That's why she voted and didn't recuse herself until she got a letter from a lawyer demanding her recusal. She then gave up without a fight. Needless to say, time will tell all.

I attended the pre-board meeting on Thursday and Pete Stenson was a real asset in what turned out to be the first productive public conversation about the town's finances in memory. He was put on the spot without warning and, as always, spoke in a straightforward way about steps he had taken and where he left things when the new majority took over in January. I know Pete doesn't need defending from me, especially from the clowns on the non-blog, but this would be a much better town if everyone conducted themselves in public like Pete Stenson. No matter how heated things get, he's always a gentleman. If you ask him a question, you get an answer, and if he asks you a question he actually listens to your answer. I enjoy arguing with Pete as much as agreeing with him because it never gets personal and I learn a lot from his insight and experience. I realize that I can rub people the wrong way because of the way I go about things but launching personal attacks against Pete tells me more about you than him.

Clearly, to show his contempt for this committee, Langley deliberately picked someone who will be more of an impediment than an asset. Chalk up yet another error in judgment for Supervisor Langley.
ReplyDeleteHow can you possibly appt. Sean Mulvey to the CFAC when you fired his arse from the Town? Where's Langley's priorities or doesn't he have any? One minute they're enemies, next their the best of buds. Supe, where's your sense of pride? Its like you don't have a clue; well its time you at least try - 15 months is going to fly by and you'll be saying Bye Bye!! As far as your forever bud, DENFRUSCIO, send him to a GED class, would you? His grammar when he writes is very strange; can't put sentences together and his spelling is atrocious. Not fooling anybody; we know when he writes on these blogs; its obvious he doesn't have a High School Diploma? isn't he related to the Bldg. Dept. Director; that says it all.
DeleteLangley really doesn't get it! Why would you hire someone who was already in charge of our finances that failed?! STOP HIRING PEOPLE who have done nothing to get us our audit and to get our town out of debt!
DeleteIt wasn't only the casino that dragged Langley down. It was his dictator style of governing, refusal to answer questions at the Board meetings, nepotism, and withholding the audits. The casino was the final nail in the coffin...albeit a big nail.
ReplyDeleteEyes wide open people ! Mulvey is no good and nothing but a political plant to report back to Langley and Crist. He has NO accounting skills, screwed up the Town finances while he was there. Screwed up the paychecks of ALL town employees while he was there.

Sean Mulvey is not able to participate in CFAC. HE WILL TELL YOU THE LIST OF THINGS HE CAN'T DO WHENEVER YOU ASK HIM TO CONTRIBUTE. he is just a big guy thrown in on the defensive line to creat a big old dead zone. Langley and Crist won't get any accurate reports from Sean, he just isn't capable.
